Upper2bits Posted July 10, 2012 Posted July 10, 2012 We have camps in NH and ME and it's great to go up there and light up the sky but I spend most of my time in Massachusetts where even sparklers are outlawed. I was wondering if anyone knows any ways around this? Can I pay and get a license to make stuff? Can I do it as a different legal hobby(rocketry?). My last resort is to make the BP and stars and then just take a trip up north to test everything out but that's a pain in the ass.
Upper2bits Posted July 10, 2012 Author Posted July 10, 2012 After hearing from some people who probably don't want to admit they can only do it illegally I've come to the conclusion that might be my only option. After a little research it appears the fine is pretty minor if I get busted. With that in mind I will take every safety precaution and make sure everything is as legal as it could be without the licenses and permits. Possession, use, cause to explode of fireworks: Penalty: Fine and confiscation onlyFine: $10 to $100Seizure of fireworks: Mandatory. Who can seize: Any officer qualified to serve criminal process.May an officer arrest? For possession, no. Statute only provides for a fine upon conviction and automatic confiscation of fireworks. Must an officer seize the fireworks? Yes, the statute says the officer shall seizeany fireworks.

Now look for the state regs on explosives and the fed regs as well... I believe it is different for the actual classification of explosives, which ALL homemade fireworks are, they only get the name fireworks and classification with an EX number. -dag
bob Posted July 10, 2012 Posted July 10, 2012 that kind of laws are bad at best I mean really I can under stand if you come to this guys house and he has nothing but flash ok give him a fine but if you has things like stars and stuff he's making fireworks and is not going to blow up a plain he's going to light up the sky with some pretty shells or some thing and then they go and make some thing like home schooling illegal I mean what's so bad about home schooling? but they let one guy in my area that had $500,000 worth of stolen stuff and he gets six months bob
Arthur Posted July 11, 2012 Posted July 11, 2012 The only advice must be to stay within your county, state and Federal Law. Sometimes it's hard, but a conviction for illegal explosives will harm your future -even if you then move to a firework friendly state. Gain lots of theoretical knowledge and locate events in other places where manufacture is the aim of the event PGI conference seems to be the No 1 ticket, that way you manufacture and fire legally. Yes I am well aware that people will manufacture illegally especially in remote places, so will the Law be aware.
